OnlyFutanaris respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content hosted on this Site infringes your copyright, please follow the procedure below to submit a takedown notice.

How to Submit a Takedown Notice

To be effective under the DMCA, your written notification must include all of the following:

  1. A physical or electronic signature of the person authorised to act on behalf of the owner of the copyright that has allegedly been infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the specific page).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices will not be processed. Sending false or fraudulent DMCA takedown notices may expose you to liability under 17 U.S.C. § 512(f).

Our Response

Upon receipt of a valid and complete takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly.
  • Notify the user who posted the content that their material has been removed.
  • Provide the user with an opportunity to submit a counter-notification.

We aim to respond to valid notices within 3–5 business days.

Counter-Notification Procedure

If you believe that material you posted was removed as a result of mistake or misidentification, you may submit a counter-notification. To be valid, your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

Send counter-notifications to support@onlyfutanaris.com with the subject line “DMCA Counter-Notification”. If a valid counter-notification is received, we may restore the removed material after 10–14 business days unless the original complainant files a court action.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, OnlyFutanaris maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access or terminate accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

Safe Harbor Statement

OnlyFutanaris qualifies for the safe harbour protection of the DMCA service provider provisions (17 U.S.C. § 512(c)) by: (i) not having actual knowledge of infringement; (ii) not receiving a financial benefit directly attributable to infringing activity; (iii) acting expeditiously to remove infringing material upon proper notice; and (iv) maintaining the designated agent registration and this policy.
